I don't beleive that this CQ is required.

I believe that we can, in both cases, assert that the content is part of the
operating system.

If there's no technical requirement to include the header file in the
repository, it should not be included. Perhaps a notation in the NOTICES file
is sufficient?

What documentation requirement is satisfied by including this file?
