I'd open a ticket.
Regarding the retrieval of the index, I seem to remember that it is triggered every time the plug-in is activated (supposedly when Eclipse is started, but activation can delay until some specific function is triggered... I should open a ticket for that myself :-) ).

Brian also pointed out that the property file that sits alongside the index may be a more reliable source for determining whether to update the index than using the If-Modified-Since header.
Is this already under consideration or should I put it into bugzilla?
