See bug 490651 for background and the specific tests involved. There is nothing wrong with having tests that depend on "UTF-8" (or, whatever file system settings are appropriate for the tests), but then the tests themselves should check if the machine meets to qualifications and either not run at all, or perhaps print a warning, or perhaps just have one failure that clearly stats "15 test not ran due to file encoding being XXXX" (or, something better. :)
