FWIW, I am 100% comfortable with using this "escape clause" for projects that are very early in the bootstrapping process or are actually dysfunctional (i.e. we don't have confidence that committers will review contributions or vote). This is not a sledgehammer for us to use to manipulate project teams.

We can't use this "notwithstanding" clause on projects that are completely functional and following the rules (e.g. those EE4J projects that have active committers doing development in their repositories and/or have engaged in a Release Review). In this case, the right way to become a committer is to make a series of quality contributions and get invited to join the project as a committer. 

If the committers aren't reviewing contributions, then we can talk about dysfunction.

In exceptional situations—such as projects with zero active committers, disruptive committers, or no effective project leads—the project leadership chain has the authority to make changes (add, remove) to the set of committers and/or project leads of that project, and otherwise act on behalf of the project lead.

Do PMC members concur that this project is in an exceptional situation?

Jim is not currently a committer on EE4J projects (although we're trying to get him voted in on JAX-RS and Jersey projects).

When this CI/CD processing is complete, then we will consider retiring Jim from this Stable EE4J API project.  Thanks!
