Hmm. Unfortunately I wasn't able to make the call this week, so I may have
missed some additional context, or misunderstood the end of the discussion, but
I didn't get from that discussion thread that this would be exempt when it came
to point one in:

The conclusion that I thought we came to was that if there is any test code
having direct imports/references to the library API (such as the way that
EasyMock is used by test code) and the test code was in the SVN then it was a
works-with. I thought the unnecessary CQ case was when JAR was used for
testing, but there were no direct references to the API. Either way, we need a
clear example of this in our discussion thread because this is the more common
case, IMO.
